Buying and Selling of Real Estate
- Copies of identity cards and tax identification numbers of all parties with indication of marital status (and any applicable matrimonial property regime)
- Documentation indicating the origin of the property (notarial deed or inheritance)
- Copies of any preliminary contracts
- Copies of any payments already issued
- In cases involving a real estate agent: contact information of the agency and a copy of the commission payment
Additionally:
for buildings:
- Copies of documents from the Housing Department (construction permit, modifications, DIA, SCIA, CILA, safety compliance/occupancy certificate…)
- In the case of repurchase of a “first house” (tax credit): copies of the purchase deed of the new property and the deed of sale of the previous property
- Copy of the energy performance certificate
for land:
- Urban planning use class certificate (original)
- Indication of any applicable PAC title
NOTE: If the transaction is to proceed after the acceptance of an inheritance, it is also necessary to present the death certificate of the deceased. Furthermore, when dealing with a inheritance involving a will, a complete, authentic copy of the notarised will must also be presented.
